Welcome to the Mouse Life mobile app or Mouse Life website (will be referred to as the “Site/App”). The Site/App is intended to help visitors at a specific destination (“Destination”) track their experiences and learn more about the experiences, activities, and dining which the Destination has to offer, while encouraging visitors to experience new things. The Site/App is operated by the U.S. based company inData Solutions Group, LLC (“Company”) dba Mouse LIfe and is offered globally, where available.

Please read the following Terms and Conditions carefully:

These Terms and Conditions (“Terms”) govern your access and use of the Site/App, including any content, functionality, and services offered on or through the Site/App. These Terms apply whether you are a guest or a registered user
Not all features are available to all users, as access to some features require an active subscription and/or an additional purchase.
By using the Site/App, whether as a guest or a registered user, you signify your agreement to these Terms for yourself and for all persons (including minors) for whom you are utilizing the app features on behalf of. If you do not agree to these Terms, you must immediately cease using the Site/App.
These Terms apply in addition to, and not in lieu of, any Terms of Use laid out by the Destination. In the event these Terms directly conflict with the applicable foregoing Destination Terms of Use, these Terms will prevail.
Without limiting other rights and remedies available to us, if you fail to comply with these Terms we may immediately terminate this contract with you and/or delete your account or any of the features in your account, including history and digital content.

Changes to the Terms and our Site/App

We reserve the right to make changes to the Site/App and any service or material we provide through the Site/App. We are not required to give notice about changes to the Site/App.
We may revise and update our Terms at any time. Your use of the Site/App indicates you accept the current Terms of the Site/App, regardless of what was posted at the time you last accessed the Site/App and/or reviewed them.
If we make a material amendment to these Terms, we will notify you of such amendment by sending you an e-mail to the last e-mail address associated with your account, and/or by posting notice of such amendment on the Site/App by including a notation next to the link to these Terms that states "Updated as of [applicable date]."
Any such amendment to these Terms will be effective as of the date the modified or replacement Terms are posted to the Site/App, and such modified or replacement Terms will govern your use of the Site/App on and after the date the modified or replacement Terms are posted.

Access to the Site/App

As the Site/App will evolve over time, there may be periods during which certain benefits and features are made available on a limited basis to a select audience.
Availability of Site/App benefits and features is subject to change without notice.
We are not liable for any issues that arise if the Site/App is not available, whether a part of the Site/App or in its entirety.
To access certain features of the Site/App, you may need to create and be signed in to your account.
Information you provide as part of your access registration must be correct, current, and complete.
Users in other countries are not guaranteed access to the Site/App.
Your access login information is your responsibility to maintain confidentiality. We are not responsible for any issues that may arise if someone is able to obtain access to your account.
You agree that your account is personal to you, and you will not share your individual access to the Site/App with any other persons.
You agree to notify us immediately if you are aware of any unauthorized access to the Site/App using your login credentials.
It is recommended that you log out of your account when you are done each session, and take extra caution when logging into a public computer or device. Do not store personal information or passwords on a device that you do not own and cannot control access to.
We have the right to disable any account, by the username or password, at any time at our sole discretion.
If you choose to end your subscription, we are not obligated to maintain any of your historical data.

Use of the Site/App

If an attraction, entertainment, or dining experience at the Destination has age requirements, you must follow the Destination’s age restrictions. Experiences at the Destination may only be available or accessible to adults.
Availability of experiences at the Destination are subject to change without notice, and any such changes are not the responsibility of the Company.
Any expenses incurred while experiencing attractions, experiences, or dining at the Destination are the sole responsibility of the Site/App user and are not the financial responsibility of the Company.
Any injuries incurred while experiencing attractions, experiences, or dining at the Destination are not the responsibility of the Company.
Any injuries incurred while traveling to or around the Destination are not the responsibility of the Company.
We are not liable or responsible for your conduct while at or traveling to the Destination, regardless of goals or tasks detailed within the Site/App. Please always follow code of conduct rules at the Destination.
We advise you not to use this Site/App (including the camera) while driving, walking, or when being distracted or disoriented from your surroundings as it could be hazardous.

Family and Friends

The Family and Friends feature allows you to link accounts with other Site/App users based on their username and/or email address.
When a family member or friend accepts your invitation, that person can see certain information about you, including, but not limited to: your full name, your character photo, your Destination lifetime completion statistics, trip and itinerary information, and other digital content.
Any Site/App subscription fees or in-Site/App purchases made on behalf of a family or friend who’s account you maintain will be your responsibility, either solely or to be decided on between you and the family member or friend.

Storing a Credit Card to your Profile

You may have the ability to store a credit card in the profile settings in the Site/App if you are an adult.
You must sign in to your account in order to add or edit your credit card information. If you have a stored card within the Site/App, you can remove or edit your stored credit card information at any time.
For your convenience, if you save a credit card to your profile in the Site/App, your credit card information will be stored in your Site/App account until you change or remove it.
You represent and warrant that you are the authorized user of the payment card stored in your account profile.

Mobile Device Notifications

Use of our Mobile Application includes automatic approval to receive push notifications (“Notifications”) on your mobile device.
You may sign in to your account and visit the Notifications page to customize which Notifications you receive.
Your most recent preferences will remain active with your account and will be applied to future executed notifications.
Your Mobile Device Notifications preferences will only apply to the communications listed on the Notifications preference page in the Mobile Application. They will not affect other communications from us (such as email, text messages, or transaction confirmations).
Message and data rates may apply.

Destination Maps

The Site/App may provide you with a map of your destination. You may receive distance to various locations in the Destination when you use the Mobile Application and allow the Mobile Application to access your location.
Your use of maps in the Site/App is at your sole risk. Location data, directions, and travel time may not be accurate.
Do not use maps in a way that distracts you from your surroundings or prevents you from obeying laws and Destination rules.
Your use of the Destination Maps is also governed by the Google Maps Terms and privacy policy found here: http://maps.google.com/help/terms_maps.html.

Links and Associations to/from the Site/App

You may link to the homepage of our Site/App, provided you do so in a way that is fair and legal and does not damage our reputation. You may not take advantage of or profit from the Site/App without our prior written consent.
You may not claim any association with the Company or Site/App without our prior written consent.
We are not responsible for any links to other sites and resources provided by third-parties that may be shared on our Site/App. We do not control the contents or accuracy of the materials housed in the third-party sites we may link to. We accept no responsibility for loss or damage that may arise from your use of them. You accept full responsibility for accessing any third-party links from our Site/App.

Intellectual Property

The Site/App and all its contents, features, and functionality are owned by the Company.
It is protected by the United States and International copyright, trademark, and patent laws. Breach of patent will result in litigation.
You may only access the Site/App for your personal/non-commercial use, unless the Company has personally granted you permission to make commercial use of it.
You may not reproduce, distribute, modify, or create similar versions of the Site/App. You may not republish or store any of the material found on the Site/App.
If you print materials from the Site/App, it may only be used for your own personal/non-commercial use. If we provide printable versions of our material, you may download only a single copy to your computer or mobile device solely for your own personal/non-commercial use. Possession of any materials does not transfer any ownership rights of the materials to you.
You may not reproduce or modify any materials obtained from the Site/App. Do not delete or alter copyright, trademark, or other proprietary rights notices from copies of the materials from the Site/App. If we contact you due to a breach of these Terms, you must immediately return or destroy any copies of the materials you have obtained.
Use of the Site/App outside of our intended use, at our discretion, is a breach of Terms and may violate the Company’s copyright, trademark, or other laws.
The Company name, the name of the Site/App, unique terms used with the Site/App, and all related logos, designs, products, and services are trademarks of the Company or its affiliates or licensors.
You must not use such marks without the prior written consent of the Company.

Prohibited Uses

You may not use the Site/App for any unlawful purpose and must remain in good standing with these Terms.
Any actions you take in relation to the Site/App that violate any federal, state, or local laws or regulations are discouraged and not the responsibility of the Company. International laws and regulations regarding the export of data or software from a US owned application must be followed.
You may not impersonate or attempt to impersonate the Company or any of its entities.
You may not use the Site/App in any manner that could disable, overburden, damage, or impair the Site/App or interfere with another user’s use of the Site/App.
You may not use any robot or other coding or automated device with the intent of accessing data housed within the Site/App or it’s databases, or monitor use or material of the Site/App.
You may not introduce viruses or other malicious or harmful technologies that may harm the Site/App or attempt to gain unauthorized access to user’s data.

Reliance on Materials and Information

Data presented through our Site/App is solely for general information purposes. We are not held responsible for accuracy, completeness, or usefulness of the information. Any reliance you place on this information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance you may place on information obtained by you or another user from the Site/App.
Some content in our Site/App or through social media accounts may be provided by a third-party, including social media influencers. All statements and/or opinions by the third-party are solely the opinion and responsibility of the third-party and may not reflect the sentiment held by the Company. We are not responsible or liable for any third-party content, opinions, or accuracy of representation of our materials.
Content on the Site/App is not guaranteed to be current or complete. We may update the Site/App at any time. The Company is under no obligation to maintain accuracy of any material on the Site/App.

To provide you with the features and benefits of the Site/App, we collect information from you through our Site/App about your experience and views of the Destination.
Identifiable information such as your name, email address, and phone number will never be shared with or sold to a third-party.
Information obtained by the Destination through their own channels falls under their Privacy Policy and is not governed by the Company.
We may utilize data obtained through user inputs for analytical purposes, regardless of whether the user is still an active subscriber or has an active account.

Disclaimer of Warranties

Any material you download from the Site/App are at your own risk. Any virus or destructive code introduced is not the intent or responsibility of the Company. You are responsible for maintaining sufficient security protocols on your computer or mobile device.
We are not liable for any loss or damage that may occur by using our Site/App.
COMPANY WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR TO YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT. Indemnification

You agree to defend, indemnify and hold harmless the Company, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Website, including, but not limited to, your User Contributions, any use of the Website's content, services and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Website.

Governing Law and Jurisdiction

All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the state of Florida without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida although we retain the right to bring any suit, action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Waiver and Severability

No waiver of by the Company of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Company with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website and Application.
